Purchase of products

Orders

We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the ispin website.

Contract creation and electronic contracting

The technical steps required to create the contract between you and us are as follows:

You place the order for your products on the ispin website by pressing the confirmation of order at the end of the checkout process. You will be guided through the process of placing an order by a series of simple instructions on the ispin website.

We will send to you an order acknowledgement email detailing the products you have ordered. This is not an order confirmation or order acceptance.

As your product is shipped from our production site, we will send you a dispatch confirmation email.

Order acceptance and the completion of the contract between you and us will take place on the dispatch to you of the products ordered unless we have notified you that we do not accept your order, or you have cancelled it in accordance with the instructions in Change or cancel an order

·      Non-acceptance of an order may be a result of one of the following:

·      The product you ordered being unavailable from stock.

·      Our inability to obtain authorization for your payment.

·      The identification of a pricing or product description error.

·      You not meeting the eligibility to order criteria set out in the main Terms of Sale.

·      The contract will be concluded in English.

Please note that you are entitled to cancel this contract if you so wish provided that you exercise your right and notify us no longer than 14 working days after the day on which you receive the products.

If you wish to exercise your right to cancel this contract after your order has already been dispatched, we will refund the original purchase price, provided that you have notified us in writing no longer than 14 working days after the day on which you receive the products, and that you have taken reasonable care of the product(s) and not used them/it. Please follow the procedure set out in our Returns Procedure.

Description of products

Each product purchased is sold subject to its description on the ispin website, which sets out conditions related to that product including, without limitation, terms and conditions concerning estimated delivery dates and times, warranties, after-sales service and guarantees.

We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the ispin website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the website as up-to-date as possible, the information including descriptions appearing on the ispin website at a particular time may not always reflect the position exactly at the moment you place an order. We cannot confirm the price of a product until your order is accepted in accordance with our order acceptance policy.

Severance

If any part of the Terms of Sale shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the Terms of Sale and shall not affect the validity and enforceability of any of the remaining provisions of the Terms of Sale.

Waiver

No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision.

Survival

Each provision of the Terms of Sale shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.

Entire agreement

The Terms of Sale govern our relationship with you. Any changes to the Terms of Sale must be in writing and signed by both parties. In this way, we can avoid any problems surrounding what ispin and you are expected to do. You confirm that, in agreeing to accept the Terms of Sale, you have not relied on any representation save insofar as the same has expressly been made of these Terms of Sale and you agree that you shall have no remedy in respect of any representation. Your Statutory Rights are not affected by the Terms of Sale. Nothing in this clause shall limit or exclude our liability in respect of any fraudulent or negligent misrepresentation whether or not such has become a Terms of Sale.

Law

The Terms of Sale shall be governed by and construed in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the courts of England.

Change or cancel an order

If you would like to add products to your order, please place a new, separate order for these items.

To change details of your delivery address, remove items from your order or cancel it completely, please contact our Customer Service Team for advice.

If your order has already been dispatched or delivered, then you’ll need to follow our Returns Procedure.

There are some products that we are unable to cancel, refund or exchange, these products are outlined below. 

We can’t offer refunds or exchanges, unless faulty or not as described, on the following items:

·      Products which have been personalized for you

·      Made to order products

Shipping

We recommend shipping using our trackable and/or signed for service option, for example, Royal Mail Signed for service.

We reserve the right to choose an alternative carrier to those stated at the checkout should we feel that they offer a better service for shipping of our products at that particular time.

Duty and Taxes

Please be advised that your parcel might be shipped tax free. You may, therefore, become liable for import duty, taxes and charges within the destination country. ispin are not responsible for any such charges that may be applied during transit through the customs system.

Tracking your order

Once your order has been processed and dispatched, you will receive a confirmation email. Depending on the delivery service used, your tracking number may also be included within this email.

Missing or damaged orders

If you have been notified that your order has been dispatched but it has not arrived within the expected time frame please contact our Customer Service Team who will advise accordingly.

Returns Procedure

We want you to be happy with your purchase. If you’re not, or you simply change your mind, you may return your product to ispin for exchange or refund in accordance with our terms and conditions for returns and the ispin Warranty. It is important that any unwanted item, unless faulty, are returned to us in a re-saleable condition. We would expect this to mean that you’ve kept all original packaging contents and labels, and that the product is undamaged and unused.

When returning goods please use a trackable postal service, postal charges for items returned are at the expense of the returnee and ispin do not accept any liability whatsoever for charges incurred when returning any item previously supplied by us, nor for any damage or loss in transit that may occur to an item which is being returned.

International Returns

For customers requiring a return from outside the UK it is essential that you contact us by email to: info@ispin.uk

We will advise of our returns procedure for your country and provide assistance with relevant returns forms to you. It is important that these documents are completed in full to prevent any delays or extra charges through customs.

Distance Selling and Your Right to Cancel

Under the Consumer Contracts Regulations 2013, if you buy online or by phone, your consumer rights entitle you to a full refund if you request one in writing within 14 working days of receipt.

This legislation offers you the following cancellation rights when you buy online or by phone:

You are entitled to cancel your contract if you so wish, provided that you exercise your right no longer than 14 days after the day on which you receive the goods or services.

Your right to return products does not apply to goods made to your specification that have been clearly personalized.

If you wish to exercise your right of cancellation, you are obliged to retain possession of the goods and take reasonable care of them.

To exercise the right to cancel, you must inform us of your decision to cancel your contract by a clear statement, including details of your name, geographical address, details of the order you wish to cancel and, where available, your phone number and email address.

If you decide to cancel, you should return the goods to us at your cost within 14 days of such cancellation.

Once you have notified us that you wish to cancel the contract, any sum debited to us will be refunded to you as soon as possible and in any event within 30 days of your cancellation. We will reimburse to you (by the method used to pay for the original transaction) the amount in relation to goods to which cancellation rights apply.

The ispin Guarantee

Any manufacturing fault is covered by the ispin warranty for up to 30 days from the date of purchase, provided that your ispin product was sold to you either by us or an authorised stockist. ispin products are manufactured with excellence in mind, and rigorous checks on quality and standard are conducted throughout the manufacturing process prior to sale.

The ispin Warranty

All ispin products are warranted for up to 30 days from the date of purchase against breakage due to material, workmanship or manufacturer defects. Where possible we will endeavour to repair the product and, if this is not possible, we will provide you with a replacement product. Coverage is valid only with proof of purchase from ourselves directly or an authorized ispin dealer. The ispin warranty does not cover accidental damage or general wear and tear. Any alteration of a ispin product will invalidate this warranty.
